The editor presents in his commentary an academically researched and at the same time practice-oriented emphasis on the recognition of the capacity to act, to sue and be sued of partnerships through a legal decision in the supreme court. In addition to further questions with practical relevance, the liability regime of the partnership company and the question of the relevant application of trading company law on company or genuine civil associations of individuals have been reassessed.
