A Legal Dogmatic Investigation Originating from Menke's Critique of Rights«: May Christoph Menke's legal-philosophical core thesis on the form of subjective rights be evidenced through legal-dogmatic figures? To answer this question, in a first step the thesis reconstructs Menke's >Critique of Rights<. The subsequent jurisprudential analysis refers to the limitations of private autonomy in private law and to fundamental rights in public law. The final section takes up and problematizes Menke's attempt to examine the isolated form of subjective rights.
