In case of a seller's breach of contract, theparties are confronted with challengingdecisions. In particular, the question ariseswhether the buyer is entitled to avoid thecontract or whether the seller has the optionto cure the breach of contract. Especially thepossibility of a seller's cure, although widelyused in daily business, poses a multitude ofunsettled legal questions, ranging from itsacceptance in legal statutes to the actualperformance of a seller's cure.The present study is based on the UnitedNations Convention on Contracts for theInternational Sale of Goods (CISG), additionallytaking into account the situation of theseller's right to cure under English as well asSwiss Sales Law. Moreover, the discussioncovers the seller's right to cure and itsposition in standard terms. In these contexts,the author analyses the problems of, as wellas the possible solutions to, a seller's right tocure, thereby highlighting its existence, itsmodalities, the possible interests involved aswell as its consequences for the legalrelationship between the seller and thebuyer.
