The disclosure obligations regarding benefits in investment advice and the relationship between supervisory and contract law have been in focus of legal practice since 18 years. The author takes the ruling of the Federal Court of Justice of 3.6.2014 - XI ZR 147/12 as an occasion to examine the differentiation of benefits as well as to dogmatically locate a principle of transparency. She measures the tension between supervisory and contract law in regards of the judicial development of the law.

Notă biografică

Julia Redler studied law at the Humboldt University of Berlin. After her First Legal Examination in 2011, she was a research assistant at the chair of Prof. Dr. iur. Dr. phil. Stefan Grundmann LL.M. (Berkeley) until 2017. In 2014, she passed the assessor's examination at the Kammergericht. In 2017, she worked as a lawyer in a law firm specialized in banking and capital markets law in Berlin. From 2017 to 2021, she was a judge on probation in the state of Brandenburg. Since November 2021, she has been a judge at the Potsdam District Court. In 2022, under the supervision of Prof. Dr. Florian Möslein LL.M. (London), she completed her doctorate at the Philipps University of Marburg.
