Adisconnectionhashistoricallyexistedbetweeninternationalanddomesticjustice.InChina,internationaljusticeanddomesticjusticewerelongtreatedastwoautonomousyetinterconnectedsystems,akintotheconceptofYinandYang.WiththeestablishmentoftheInternationalCriminalCourt(ICC)in2002,thetwosystemsbegantoincreasinglyworkintandem.TheprincipleofcomplementarityisoneofthecornerstonesoftheICC'sarchitecture,accordingtowhichstateshaveprimaryjurisdictionovertheICC.SolongasthelegalsystemofastatecanefficientlyinvestigateandprosecutethecoreinternationalcrimesprohibitedintheRomeStatute,theICCwillnotintervene.However,ifastateisunwillingorunabletoinvestigateandprosecutethesecrimes,theICCwillinvoketheprincipleofcomplementaritytostepin.Thus,theprincipleofcomplementarityhasanimpactonthenationalimplementationofinternationalcriminallaw,aswellasonitsexerciseofjurisdictioninmanyaspects,includingforthirdpartystates.AsathirdpartystatetotheICC,Chinahasratifiedanumberofinternationalconventions,includingthoseongenocideandtorture;Chinaisthereforeobligedtoprosecutetheseinternationalcrimesbyimplementingtheseinternationalconventionsintonationallaw.However,thecorecrimeshavethusfarnotbeenincorporatedintoChinesecriminallaw.ThisresearchworkfocusesonthepossibleimpactoftheprincipleofcomplementarityontheimplementationofinternationalcriminallawinChinaasathirdpartystateandthefutureprospectsoftherelationshipbetweenChinaandtheICCbasedonthisanalysis.Bysodoing,itaimstocontributetothediscourseoncomplementarityforbothscholarsandpractitioners.
