International Aviation Law: A Practical Guide

Autor Ronald I. C. Bartsch AM
en Limba Engleză Paperback – 16 oct 2024
This is the third edition of a now-renowned guide that provides an extensive account of the state of the aviation industry and the law that regulates it. This new edition, revised and updated throughout, focuses on environmental and sustainability considerations, and includes a new chapter on innovations aimed towards meeting the 2050 Net Zero Emission targets endorsed by the International Civil Aviation Organisation (ICAO) and the International Air Transport Association (IATA).
International Aviation Law: A Practical Guide explains the international context and application of the law as it applies to commercial and recreational aviation, and to the broader aviation environment. It provides a comprehensive introduction to all aspects of aviation law, from criminal law to contract law, to the legal duties and responsibility of aircrew and other aviation personnel including airport operators, air traffic controllers and aircraft engineers. Each area of the law is clearly explained in accessible language and supported with practical case studies to illustrate the application of the law within an operational aviation context. It also provides advice on how to avoid or minimize legal liability for those working in the aviation industry.
The book is written for a very broad readership of those working within the aviation industry, those aspiring to work within it and those within the legal profession dealing with air transportation, as well as students within the same industries. The third edition will additionally find favour with new readers seeking information on environmental issues and answers to the question of how the aviation sector will meet the 2050 emission targets.

Recenzii

'Aviation law is not just a subject for lawyers. The nuances of aviation law affect the day-to-day life of operational aviation professionals. Criminalization can make or break a company’s safety culture. The Convention for Mobile Equipment can make it possible for a country to operate the latest aircraft, or force it to live with surplus wrecks. Few people really understand how these pieces fit together. This book does it well, and is important for anyone who is trying to understand how international aviation works.' - William R. Voss, President and CEO, Flight Safety Foundation, Washington DC, USA
'Aviation has an intrinsically international context and so does the law governing it. Indeed, the cornerstone of aviation regulation is founded in international conventions, particularly the Chicago convention. In this text the author astutely identifies and explains the specialised nature of aviation law and how that law applies in different legal systems throughout the world, with an emphasis on commonality in the law. This text is an essential tool not just for lawyers, but for all who work in the aviation industry.' - John Dawson, President, Aviation Law Association of Australia and New Zealand
'No other field of human endeavour is so directly and intrinsically dependent upon the international context than is the case with aviation. This book explains, in a digestible yet articulate style, the basis and structure of the law as it applies to the modern world of aviation. From a personal perspective International Aviation Law provided me with a far greater appreciation of the extent to which the law and regulations impinges upon virtually every facet of the industry. More importantly, a good understanding of aviation law could help avert a major disaster for the Company. I would highly recommend this book to anyone who has any involvement in the aviation industry.' - Lim Kim Hai, Executive Chairman, Regional Express, Australia

'Much like the first edition of his book, this edition is well-written, easily accessible to the lay as well as professional reader [..]. It is also thorough (examples from case law are placed throughout the text and have been updated to provide recent cases where relevant) and brought up to date with chapters updated to reflect recent developments in, of particular interest to many, international carriage by air and the accordant losses which can result from this, commercial and competition law, and environmental law.' - Alan D Meneghetti, Aerospace, July 2020

‘The modern airline pilot has three primary legal obligations in their working day: a statutory obligation to their regulator as a licence holder; a contractual obligation to their employer; and an obligation through the common law duty of care to their passengers and the general public. And all this while operating in a jurisdiction using international law and conventions. This text helps the individual to understand how international aviation law influences the world they work in and the decisions they make.
Graham Thomas, Training Captain B777/787, UK

‘This publication is a "must have" for the dedicated aviation practitioner including pilots, aircraft engineers, airport operators, air traffic controllers and aviation insurers. In saying that, others, such as students studying aviation law who are passionate about this ever changing industry would also find International Aviation Law beneficial.’
Aviation Business Asia Pacific, March/April 2013

‘Mr Bartsch has written a book which will be of interest to the newcomer to the aviation industry and to air law, as well as to the individual who wishes to refresh his memory on a particular topic.’
